My Treat Bag LLC and its affiliated companies (together, "Mytrickortreat," "we" or "us") offer this website and other websites, webpages, games, widgets and online services on which these Terms of Use are posted or linked (collectively, the "My Trick or Treat Sites"). We hope you find them informative and entertaining.

These Terms of Use and our Privacy Policy at www.mytrickortreat.com/privacy (together, these "Terms") describe the terms on which we offer you access to the My Trick or Treat Sites.

Before using the My Trick or Treat Sites, please read these Terms carefully because they are a legal agreement between My Trick or Treat and you.

BY USING THE MY TRICK OR TREAT SITES, YOU AGREE TO THESE TERMS AND AFFIRM THAT YOU ARE ABLE AND LEGALLY COMPETENT TO DO SO.

IMPORTANT NOTE: THESE TERMS CONTAIN PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE SEE "DISCLAIMERS OF WARRANTIES & LIMITATIONS OF LIABILITY" (SECTION 9).

IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS, PLEASE DO NOT USE THE MY TRICK OR TREAT SITES.

1. CHANGES TO TERMS

The Effective Date of these Terms is shown at the top of this page. We do not intend to change these Terms very often but reserve the right to do so. We will notify you of any material change by posting notice on this page. Whenever possible, we will notify you in advance. We do not make changes that have retroactive effect unless we are legally required to do so.

Your continued use of the My Trick or Treat Sites after the Effective Date means you accept the amended Terms. The amended Terms replace all previous versions. We encourage you to review these Terms from time to time.

2. ADDITIONAL RULES

Some features, such as games or leaderboards, may show additional rules when you use them. Those rules apply together with these Terms.

3. MY TRICK OR TREAT CONTENT

My Trick or Treat keeps full title to all information and materials provided on or through the My Trick or Treat Sites, including artwork, graphics, text, video and audio clips, trademarks, logos and other content (collectively, "My Trick or Treat Content"). My Trick or Treat Content is protected by copyright and other laws. Copyright 2020-2026 Robert Mitchell. All rights reserved. MYTRICKORTREAT is a registered trademark of Robert Mitchell.

If you agree to these Terms (and any additional rules related to specific content), you may download, print and copy My Trick or Treat Content for your own personal use. Our printable coloring pages are free for personal, family, classroom and non-commercial party use. You may print as many copies as you need for those uses. You may not sell them or post them on another website.

Pumpkin patch and attractions directory. The pumpkin patch and attractions directory on the My Trick or Treat Sites, including the selection, arrangement and compilation of listings, the region pages, and our original region descriptions, is My Trick or Treat Content. You may not copy, scrape, harvest, reproduce, republish or redistribute the directory or any substantial part of it, by any means, in any website, directory, app, database or dataset, whether commercial or not, without our prior written permission. You may link to our pages.

Unless My Trick or Treat gives you written authorization, you may not:

- Incorporate any My Trick or Treat Content into any other work (such as your own website) or use it in any public or commercial manner;
- Copy, modify, reproduce, adapt, reverse engineer, distribute, frame, republish, upload, display, post, transmit, transfer, license or sell My Trick or Treat Content in any form or by any means; or
- Change any notices about copyright, trademarks or other intellectual property rights that are part of the My Trick or Treat Content.

4. MESSAGES AND FEEDBACK

Parts of the site, such as the Contact page, let you send us a message. If you send us feedback, ideas or other material, you give us permission to use it to improve the site without payment. We will not publish your name or message without asking you. Please do not include sensitive personal information in messages.

Game leaderboards show a generated name and a score. They do not accept names or text typed by players.

5. USING THE MY TRICK OR TREAT SITES

The My Trick or Treat Sites are meant for parents, guardians and families. Children under 13 should use the games and coloring pages only with a parent or guardian, and should not send us personal information. We do not knowingly collect personal information from children under 13. Parents with a concern can email info@mytrickortreat.com. See our Privacy Policy.

If you are a parent or guardian who lets a child use the sites, you are responsible for that use and agree to these Terms for yourself and your child.

While using the My Trick or Treat Sites, you will not:

- Create a false identity or impersonate any person, including falsely indicating that you are a My Trick or Treat official or representative;
- Send through the sites any advertisement, solicitation, junk mail or other unsolicited commercial content (unless we expressly permit it in writing);
- Disrupt or attempt to disrupt the proper working of the sites (for example, by hacking into our servers or social media accounts);
- Restrict or inhibit any other person from using and enjoying the sites;
- Use any spambot, bot net or other bot, scraper or other automated means to access the sites, or transmit any virus, worm, Trojan or other malware;
- Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of the sites;
- "Frame" or "mirror" any part of the sites unless you have our prior written authorization;
- Post or transmit any material or engage in any behavior that is false, misleading, unlawful, offensive, disruptive, harmful or otherwise objectionable (as determined by My Trick or Treat); or
- Assist any person in doing any of the above.

We may end your access to the My Trick or Treat Sites without notice for any violation of these rules.

6. GAMES AND LEADERBOARDS

Our games are provided for entertainment, free of charge. Scores, leaderboards, weekly and monthly winners and any recognition are for fun only and may be reset, corrected or removed at any time. Do not use cheats, bots, modified game files or exploits to post a score. We may remove any score or name from a leaderboard, or stop a game, without notice. Games are provided "as is" (see Section 9).

7. THIRD-PARTY WEBSITES AND LISTINGS

The sites may contain links to third-party websites and services, including social media (collectively, "Linked Sites"). Linked Sites are not under our control, and My Trick or Treat is not responsible for them or for any information or materials on, or any transmission received from, any Linked Site. A link does not mean we endorse the Linked Site or are associated with its operators. We do not investigate, verify or monitor Linked Sites. We provide links for your convenience only. You access Linked Sites at your own risk.

This includes the farms, attractions and events listed on our pumpkin patch map and region pages. We collect information from public sources and the attractions' own websites, and it may be out of date. Always confirm dates, prices and hours with the attraction before you go.

8. PRIVACY

Please read our Privacy Policy to learn what information we collect on the My Trick or Treat Sites and how we use it. Without limiting the Privacy Policy, you understand that we do not and cannot guarantee that your use of the sites, or information you provide through them, will be private or secure. You are responsible for using the precautions and security measures that suit your situation. We may disclose any information we think necessary to satisfy any applicable law, regulation, legal process or governmental request.

9. DISCLAIMERS OF WARRANTIES & LIMITATIONS OF LIABILITY

My Trick or Treat warrants that it has validly entered into these Terms and has the legal power to do so. You warrant that you have validly entered into these Terms and have the legal power to do so.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE MY TRICK OR TREAT SITES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. My Trick or Treat specifically disclaims all warranties and conditions of any kind, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, freedom from defects, uninterrupted use and all warranties implied from any course of dealing or usage of trade. My Trick or Treat does not warrant that (a) the sites will meet your requirements, (b) their operation will be uninterrupted or virus- or error-free, or (c) errors will be corrected. Any oral or written advice from My Trick or Treat or its authorized agents does not create any warranty. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

YOUR USE OF THE MY TRICK OR TREAT SITES IS AT YOUR OWN RISK.

YOU AGREE THAT IN NO EVENT WILL MY TRICK OR TREAT BE LIABLE (Y) FOR DAMAGES OF ANY KIND, INCLUDING DIRECT, INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS OF USE, DATA OR PROFITS OR BUSINESS INTERRUPTION), HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE), EVEN IF MY TRICK OR TREAT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, OR (Z) FOR ANY OTHER CLAIM, DEMAND OR DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE MY TRICK OR TREAT SITES.

The foregoing disclaimer of liability will not apply to the extent prohibited by applicable law in the jurisdiction of your place of residence. You acknowledge and agree that the above limitations of liability, together with the other provisions in these Terms that limit liability, are essential terms, and that My Trick or Treat would not be willing to grant you the rights in these Terms without your agreement to them.

LEGAL NOTICE FOR NEW JERSEY RESIDENTS: The limitations of liability and exclusion of damages in this section do not apply to New Jersey residents.

10. INDEMNIFICATION

You agree to indemnify and defend My Trick or Treat and its directors, officers, employees and agents from and against all losses, liabilities, actual or pending claims, actions, damages, expenses, costs of defense and reasonable attorneys' fees brought against My Trick or Treat by any third party arising from your violation of these Terms, the rights of a third party or applicable law. My Trick or Treat may, at its own expense, assume the exclusive defense and control of any matter subject to indemnification. No settlement that affects the rights or obligations of My Trick or Treat may be made without its prior written approval.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Washington, without giving effect to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from or relating to these Terms or the My Trick or Treat Sites will be brought in the state or federal courts located in King County, Washington, and you and My Trick or Treat consent to the jurisdiction of those courts. Nothing in this section limits any right you have under law that cannot be waived.

12. TERMINATION

These Terms automatically end if you fail to comply with any term or condition of them. My Trick or Treat may end or change your access to the sites at any time, with or without notice. Termination does not limit any of our other rights or remedies. Sections 3, 9, 10, 11 and 16 survive termination of these Terms.

13. JURISDICTIONAL ISSUES; TAXES

You are responsible for compliance with all applicable laws. My Trick or Treat may limit the availability of the sites and any content to any person or geographic area at any time. You are solely responsible for any duties, taxes, levies or fees imposed in connection with your use of the My Trick or Treat Sites.

14. NOTICE TO CALIFORNIA RESIDENTS

If you are a California resident under age 18 and believe you have publicly posted content on the My Trick or Treat Sites, you may ask us to remove it by emailing info@mytrickortreat.com with a description of the content. We will make a good faith effort to remove it from public view as soon as reasonably practicable. Removal may not be complete: content may remain in backups or caches, or on other sites where someone else shared it, and we may be required by law to keep it.

With respect to any electronic commercial service (as defined under California Civil Code Section 1789.3) offered on or through the My Trick or Treat Sites, California residents are entitled to the following consumer rights information. The provider of the My Trick or Treat Sites is:

You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 400 R Street, Suite 1080, Sacramento, California 95814, or by telephone at 916-445-1254 or 800-952-5210.

BY USING THE MY TRICK OR TREAT SITES, YOU WAIVE YOUR RIGHTS WITH RESPECT TO CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

15. CLAIMS OF COPYRIGHT INFRINGEMENT

We respond to notices of alleged infringement as required by the U.S. Digital Millennium Copyright Act ("DMCA"), including by removing or disabling access to material claimed to be infringing.

If you have a good faith belief that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have otherwise been violated on or through the My Trick or Treat Sites, please send your notice to our DMCA agent:

16. MISCELLANEOUS

These Terms, together with our Privacy Policy, are the entire understanding between My Trick or Treat and you on these matters, and there are no other promises or undertakings.

These Terms benefit and bind My Trick or Treat and you and your respective successors and assigns. We may assign them, but you may not assign them without our prior written consent.

If any provision of these Terms is or becomes unenforceable or invalid, the remaining provisions continue with the same effect.

If either party fails to enforce a term, that failure is not a waiver and does not prevent enforcement on any other occasion.

Nothing in these Terms makes either party the agent, representative, joint venturer or partner of the other.

If either party is prevented from performing an obligation by a cause beyond its reasonable control, its performance is extended for the period of the delay.
